Data enrichment

The Data enrichment feature offers the ability to enrich data collected as a consequence of the usage of Services or, in other words, to obtain additional data from other sources to have a more complete information or profile about the person that has answered a form.

Data enrichment is subject to the limits set forth in the plan you have purchased. Those limits relate to the amount of data you have obtained via Data enrichment. By way of example, if you have a limit of 10,000 enrichment API credits, each time there is an API call run on an email address in a form, and it returns enrichment data, it will count as 1 credit. If you happen to reach the applicable limit to your plan, the form in which Data enrichment is active will keep open and collecting responses, but those will not be subject to obtaining additional data from other sources as set forth in these terms. For clarification purposes, if you have been let use this feature as part of a trial, limits will be enforced as soon as your trial period ends.

Data contributed as part of the Data enrichment feature has been obtained from third-parties, and requires that you share the e-mail address of the person at issue in respect of which the data enrichment process has to be performed (i.e. the respondent to one of your forms) (the "Enriched Data"). We need the collaboration of third parties, such as ZoomInfo Technologies LLC (dba. ZoomInfo) and/ or FullContact, Inc. (dba. FullContact). Please, acknowledge that ZoomInfo and FullContact are not an affiliate, partner, agent or representative of us (the "Enriching Providers").

We do not own the Enriched Data and we do not make any guarantees, representations or warranties of any kind to you regarding the ownership or your right to use the Enriched Data. We disclaim any liability for any third-party rights, including the accuracy, integrity, quality, legality, usefulness or safety, or any intellectual property rights therein. The availability of this Enriched Data does not imply our endorsement or affiliation with any provider and does not create any legal relationship between such provider and you.

You are solely responsible for your use of the Enriched Data when using the Data enrichment feature, and any losses or liabilities of any kind associated to that use. You (i) shall comply with all rights, obligations, conditions, policies, laws and regulations applying to the obtention and usage of such Enriched Data. In particular but without limitation, you are responsible for providing any notice and/or obtaining any consent from respondents, where appropriate; (ii) shall not transfer, distribute, or sell the Enriched Data to any other party; and (iii) shall use Enriched Data for your own internal business purposes or your business to-business sales, marketing, or recruiting purposes only. For clarification purposes, but without limitation, you shall not use Enriched Data (i) to determine any person’s employability, credit worthiness, credit standing, credit capacity, or other characteristics related to such person’s manner or mode of living, as listed in Section 603(d) of the Fair Credit Reporting Act; (ii) to make a decision by automated processing, unless where permitted and in compliance by European Union data protection laws, to evaluate, analyze, or predict an individual’s preferences where the decision results in the provision or denial of financial or lending services, housing, insurance, education enrollment or opportunity, criminal justice, employment opportunities, health care services, or access to essential goods or services; and (iii) to build or support products or services that are competitive with those of the Enriching Providers.

Furthermore, you represent and warrant that, per the collected information necessary to receive the Enriched Data (i.e. e-mail addresses), you have obtained or possesses all rights necessary, including any third party consents required under applicable laws, to authorize us to share it with the Enriching Providers for the purposes contemplated hereunder. You shall defend, indemnify, and hold us harmless from and against any and all Losses, arising out of any Action brought by a third party related to your use of the Data enrichment feature and Enriched Data.

All rights to Enriched Data will automatically terminate upon termination of the applicable Agreement. You shall delete all Enriched Data upon termination of the Agreement, other than (i) any data that was already in your possession prior to using the Data enrichment or (ii) insights derived from Enriched Data provided that (A) does not contain any raw Enriched Data, and (B) is not capable of being reverse engineered, decompiled, disassembled or otherwise modified to obtain the original, unaltered form of the Enriched Data.

Our product is not conceived to be used as a data repository for Enriched Data. Consequently, we reserve the right to delete Enriched Data from our Service on a recurrent basis, to ensure we take the necessary actions to protect our platform and legitimate interests, or when required under the arrangements in place with the third party service providers providing the Enriched Data.

The usage of this feature is fully subject to the relevant Agreement, which shall be incorporated herein by reference. Any terms not defined in these specific terms shall have the same meanings attributed to them in the Service Terms and Conditions.
